Terms and Conditions

In consideration of the monies received and mutual promises, contained online and herein, the Owner (James River House LLC) hereinafter referred to as ”Owner or Agent”, does hereby lease and rent to Tenant the certain property described online and herein, hereinafter referred to as “ The Property” under the terms and conditions, described online and herein, hereinafter referred to as ” The Terms”.

Unit information, rental rate and other details are set forth in the agreed upon online booking and are further clarified and enforced by this lease. Owner is not responsible for confusing/contradictory policies or automated emails sent by VRBO, Homeaway, Trip Advisor, AirB&B or any other online advertising portals as these are constantly changing and are outside of the control of the Owner. In cases where there is a conflict between information and/or terms found online and in this agreement the more stringent terms shall apply. It is the responsibility of the Tenant to get clarity from Owner on any items prior to booking.

Reservation Confirmation: To be fair, all reservations are confirmed on a first come, first served basis. Tenant’s reservation will not be secured until Owner has reviewed and accepted the details of the booking and acknowledged this via direct communication with the Tenant. By booking online the Tenant has digitally acknowledged that they have read and agreed to the terms described online and in this agreement and provided funds of at least 50% of the total amount. Tenant’s final payment is due 30 days prior to arrival. This payment includes: The balance of Rent, Cleaning and Security. Once this final payment is made the Tenant will receive a confirmation email from Owner with directions and other useful information.

Method of Payment: Our best recommendation for securing your reservation is to utilize the payment process found online as part of your booking.

Last Minute Rentals: If you place a reservation less than 30 days from arrival, the Total Balance is due in full. ALL RESERVATIONS MUST BE PAID IN FULL PRIOR TO CHECK IN.

Pets: The James River House is a dog paradise and we welcome your four legged family members. To respect all guests and ensure the property is enjoyable to all: Tenant MUST clean up after their pets. This includes removing dog hair from the house and disposing of all dog waste material (poo). If any waste material is found on the property, Tenant’s security deposit will not be refunded. Tenant must also maintain control of their pet at all times, and NEVER leave a pet unattended. If you are leaving for the day and don’t want to take the pet with you, you must put it in a kennel/crate or find alternative solutions to leaving the pet alone at the property. Tenant must clean the home to ensure pet hairs are not on the furniture. Any complaints from neighbors regarding excessive noise or other nuisances may be cause for immediate termination of the lease and forfeiture of the Tenant’s entire security deposit. Pets are not permitted on any furniture!!! No pet shall be tied outside the house unless supervised by a responsible adult.

Family Groups Only: We rent to Family Groups Only. Fraternal, sorority, student or single groups are asked not to apply for accommodations. The James River House is a family-oriented property; therefore, house parties are absolutely prohibited and occupancy is limited to the number of persons stated in the reservation. Tenant acknowledges that he or she will personally occupy the property for the entire lease period and will not sublet any portion of the property. Misrepresentation of occupants, house parties, or exceeding the house limit will result in forfeiture of security deposit and guests being asked to immediately vacate the property without refund. Occupancy and use of premises shall not be such as to disturb or offend neighbors. The use of firearms, or fireworks is strictly prohibited.

Check-in: Check in time is 4:00 PM. The key code will be given to you on the day of your arrival. Directions and key code WILL NOT be provided with a balance owing. DO NOT PARK OR DRIVE IN THE YARD! Parking is only allowed in the parking lot and each space is marked with a timber parking block. Refer to the check in/out document provided in your confirmation packet (emailed after final payment) for more details.

Check-out: Check out time is 11:00 AM. Tenant shall remove any remaining trash and recycling and secure in the trash bin in the parking lot. As a convenience to the Tenant the Owner will dispose of these items to make the Tenant’s check out/travel day more enjoyable. The bin shall NOT be stuffed with a week’s worth of trash. Tenant shall make sure the trash/recycle bags do not leak and are not over stuffed. Pack them as if they are going inside your car. Refer to the check in/out document provided in your confirmation packet (emailed after final payment) for more details.

Extended Stay(s): Should you wish to check in early or check out late we offer these as extended stay options. Each extended stay option adds 6 hours to your rental period. This changes your check in time to 10am or your check out time to 5pm. Each extended stay is $75 and these funds must be paid directly at the time of your request. Final approval for extended stay(s) can not be given until the day before your arrival or departure as it requires a vacancy on the day of your extended stay. Should the extended stay day be occupied the fee is refunded. If you are interested in one or both of these options just let us know.

Trash and recycling:
Tenant shall remove trash and recycling and dispose of at the Surry trash and recycling center. Owner has provided a trash and recycle bin in the parking lot to serve as a temporary holding place for these bagged items once removed from the house. This bin is kept clean so please make sure bags are not overstuffed or leaking. Refer to the trash/recycling document provided in your confirmation packet (emailed after final payment) for more details.

Maintenance/Refunds: All equipment should be in working order. Please report any inoperative equipment to us promptly. We will make every effort to have repairs made as soon as possible. Owner & Agent shall have the right to inspect and make repairs during the rental period. Guest shall be charged for any unnecessary maintenance calls. No reduction of rent, rebate, or refund will be issued for any mechanical failure of air conditioning, major or minor appliances, public utility interruptions, guest dissatisfaction, or for errors in brochure, website, reservation agreement including property changes made by Owner in bedding, furnishings, equipment, etc. There will be no refunds for inclement weather, including hurricanes.

Sleeping Capacity/Disturbances: Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: A.) Occupancy exceeding the sleeping capacity stated on the reservation confirmation. B.) Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age. C.) Causing damage to the premises rented or to any of the neighboring properties. D.) Any other acts which interferes with neighbors’ right to quiet enjoyment of their property. E.) Trespassing on adjacent properties.

Care Of Property: Tenant is expected to care for the property as if it were their own. In addition, Tenant acknowledges that unless Owner is notified on day of check-in of any damage or cleaning concerns, then thereafter, all damages or concerns to the property during the occupancy will be Tenants responsibility and must be reported to Owner and paid prior to departure. Rearranging of furniture is not permitted. No Pet hair anywhere in the home. Cottage must be left the same as you found it. Failure to comply will give the Owner the right to deduct appropriate sums from the security deposit prior to returning the balance to Tenant. Traffic of any kind in the yard or walking paths is not allowed. A full loss of security deposit will result if there is vehicular traffic on areas of the property other than the parking lot and driveway.

Cleaning: The River House will be inspected, sanitized and cleaned after your departure. The cleaning fee you have paid will provide for routine cleaning and sanitizing so that you can enjoy your vacation up to the last moment. YOU ARE REQUIRED to leave the property in the same general condition that you received it by making sure, dishes are done and put away, and the home is generally picked up and ready to be vacuumed, dusted and sanitized. If additional cleaning is required, appropriate charges will be deducted from your security deposit. If you would like a cleaning during your stay let us know and we can schedule it for you.

Items Left Behind: Owner is not responsible for items left at the property by Tenant. Please double check for all personal items before departure. A $50 fee plus shipping will be required to return by mail any items left at property.

Fires and Grilling: SMALL fires are permitted ONLY in the fire pit. Small fires are only permitted when the following conditions are met: 1. Responsible adult is present 2. It is not windy 3. The fire pit water hose is on and tested/primed. 4. There are no accelerants used other than a starter log 5. When finished, the fire is COMPLETELY EXTINGUISHED and 5+ gallons of water are used on coals. Grilling is permitted only on the deck. ABSOLUTELY NO GRILLING ALLOWED ON THE GROUND OR NEAR WOODED AREAS. Use of fireworks or firearms is prohibited.

Water: NO PORTABLE HOT TUBS ARE ALLOWED ON PREMISES.

Cancellations/Modifications: Should Tenant wish to cancel or modify this reservation, notice MUST BE IN WRITING AND RECEIVED BY OWNER MORE THAN 30 DAYS PRIOR TO YOUR CHECK IN DATE. There is a $150 cancellation/modification fee that must be paid directly to Owner. Owner will then refund the remaining sums paid, so long as Owner is able to re-rent the property to someone else, at the same rate, for the same period. If Tenant’s notice of cancellation is RECEIVED LESS THAN 30 DAYS PRIOR TO CHECK IN DATE, Tenant will forfeit all sums paid.

Termination: If the Tenant or any member of his/her party violates any of the terms of this agreement, the Owner may, at the Owner’s sole discretion, terminate this lease with no refund of any/all portions of the rents/fees collected and may enter the premises and remove Tenant, the members of his/her party and their belongings. Tenant is notified that they will be subject to an expedited eviction procedure pursuant to the ”Vacation Rental Act”.

Locked Areas: for which Tenant is not provided a key, such as owner’s personal storage areas, are exempt from this lease agreement and are off limits to the Tenant. Forced entry into these areas is cause for immediate termination and Tenant will be charged for damage and/or missing items.

In The Event: that the Owner is unable to deliver said property to Tenant under this lease agreement prior to occupancy because of fire, eminent domain, act of nature, double booking, delay in construction or any other reason whatsoever, Tenant hereby agrees that Agent’s and Owner’s sole liability as a result of these conditions is a full refund of all consideration previously tendered by Tenant. Pursuant to the terms of this lease, Tenant expressly acknowledges that in no event shall Agent or Owner be held liable for any consequential or secondary damages, including but not limited to, any expenses incurred as a result of moving for any damage, destruction or loss.

Indemnity: The Tenant agrees to release and indemnify the Owner and Agent from and against all liability, for loss, damage, injury or death to persons or their personal property. Should anyone be injured upon the premises during the term of the lease, resulting from any cause, whatsoever, Tenant agrees to take full responsibility.

Tenants Liability: Tenant agrees to accept liability for any damages caused to the property (other than normal wear and tear) by Tenant or Tenant’s guests, including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. If damages are in excess of the security deposit being held, Tenant agrees to reimburse James River House LLC for costs incurred to repair/replace damaged items.

Additional Terms And Conditions: The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury, death or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs. A violation of any terms listed in this lease will result in the loss of security deposit.

Losses And Damages: Any and all damages to the home or negligence resulting in damage to the home or contents will result in costs to repair being deducted from the security deposit or billed to the guest if said damage or loss of contents is greater than security deposit. Guest(s) shall be solely responsible for any property damage, accident/injury to any person or loss sustained by any person, including loss of money, jewelry, and other items of personal property, arising out of or in any way related to Guest(s) use of premises or the items of personal property provided by James River House LLC at Guest(s) request. Guest(s) hereby agrees to INDEMNIFY and hold James River House LLC harmless of any and all claims including those of third parties, arising out of, or in any way related to Guest(s) use of premises or the items of personal property therein. Guest(s) assumes the risk of injury or other losses relating to any recreational activities or services ordered through James River House LLC for guest use and will hold OWNER and its Agents harmless with respect there to.

ADDITIONAL PROOF OF RECEIPT AND ACKNOWLEDGMENT: Tenant shall email Owner directly (reservations@visitanalog.com) with the following information as further proof of receipt and acknowledgment of these Terms.

THIS IS A VACATION RENTAL AGREEMENT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR ACKNOWLEDGMENT OF THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THIS AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO LEASE THIS PROPERTY FOR A VACATION RENTAL.
